Welcome to PulseBoard — the operating layer for engineering. These Terms of Service ("Terms") govern your access to and use of our website, applications, and the PulseBoard service (together, the "Service") provided by PulseBoard, Inc. ("PulseBoard," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
01Acceptance of terms
By creating an account, requesting beta access, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Service on behalf of a company or other organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
02The service
PulseBoard is an operating layer for engineering teams that connects to engineering tools (including Linear, GitHub, Slack, Notion, Productboard, and others) to surface delivery risk, generate recommendations, and execute actions across your stack. We may add, modify, or remove features over time.
03Private beta terms
The Service is currently in private beta. Access is limited and provided at our discretion. Features may change, break, or disappear without notice.
While the Service is in beta:
- Access is granted at our sole discretion and may be revoked at any time
- The Service may have bugs, incomplete features, or unexpected downtime
- We may add, modify, suspend, or discontinue features without prior notice
- Beta features are provided "as is" — we make no guarantees about availability or performance during this period
- We may collect additional feedback, telemetry, and usage data to improve the Service
- We may contact you with questions, surveys, or requests for input
We will give reasonable notice before transitioning the Service out of beta and into a production tier with associated fees.
04Your account
- You must be at least 16 years old and legally able to enter into binding contracts to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- Notify us immediately at open_admin@pulseboard-ai.com if you suspect unauthorized access.
- You agree to provide accurate, current, and complete information during registration and to keep it updated.
05Acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of any law
- Attempt to reverse engineer, decompile, disassemble, or extract source code from the Service
- Probe, scan, or test the vulnerability of the Service without our express written authorization
- Interfere with the Service's operation, including by introducing malware or attempting denial-of-service
- Resell, sublicense, white-label, or redistribute the Service without permission
- Use the Service to send unsolicited communications or spam
- Misrepresent your identity or affiliation
- Use the Service to develop a competing product or to benchmark against the Service for publication
- Circumvent any access controls or rate limits
06Connected tools
- You represent that you have the authority and any necessary permissions to connect each tool you authorize.
- You grant PulseBoard a limited license to access, read, and process data from connected tools solely to provide the Service.
- You can revoke access to any connected tool at any time. Revocation will stop further data ingestion immediately.
- Your use of each connected tool remains governed by that tool's own terms of service. PulseBoard is not responsible for the connected tools.
07Intellectual property
Our intellectual property
PulseBoard and our licensors own all rights, title, and interest in and to the Service, including all software, designs, documentation, logos, and content (other than Customer Data, defined below). These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during the term.
Your data
"Customer Data" means data you provide to PulseBoard or that PulseBoard accesses through your connected tools, along with the outputs we generate that are specific to your account (signals, recommendations, computed metrics, memory). You retain all rights in your Customer Data. You grant us a limited license to host, store, process, transmit, and display Customer Data solely to provide and improve the Service.
Aggregated data
We may use aggregated, anonymized, or de-identified data derived from Customer Data to operate, improve, and develop the Service, including for benchmarking, training models, and product analytics. Aggregated data does not identify you, your organization, or any individual.
Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.
08Confidentiality
- We treat your Customer Data and connected tool integrations as confidential and protect them in accordance with our Privacy Policy.
- You agree to keep any non-public information about the Service — including beta features, pricing, technical architecture, and roadmap — confidential during and after the beta period.
- Either party may disclose confidential information when required by law, with reasonable notice to the other party where legally permitted.
09Fees and payment
- During the private beta, the Service may be provided at no cost or at preferential pricing communicated separately.
- Production pricing will be communicated to you before any charges are applied.
- We will provide reasonable notice of any pricing changes for paid tiers.
- Fees are exclusive of taxes, which are your responsibility unless otherwise stated.
10Disclaimers
Recommendations, signals, and other outputs of the Service are provided for informational purposes. You are responsible for the decisions and actions you take based on them. PulseBoard is not a substitute for the judgment of qualified engineering, product, or program leadership.
11Limitation of liability
Our total cumulative liability under these Terms will not exceed the greater of (a) the amounts you paid to us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12Indemnification
You agree to defend, indemnify, and hold harmless PulseBoard from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your Customer Data or your connected tools; (c) your violation of any law or third-party right; or (d) any content you submit to the Service.
13Termination
- You may terminate your account at any time by closing it through the Service or by emailing open_admin@pulseboard-ai.com.
- We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or for any reason during the beta period.
- Upon termination, your right to access the Service ends. We will delete or return your Customer Data in accordance with our Privacy Policy.
- Sections that by their nature should survive termination — including Intellectual Property, Confidentiality, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will survive.
14Changes to these terms
We may modify these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service before the changes take effect. Continued use of the Service after the effective date of any updated Terms constitutes acceptance of those Terms.
15Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
If you are a customer outside the United States, additional or alternative laws may apply where required by your local jurisdiction. We will work in good faith to comply with applicable mandatory consumer-protection laws.
